Terms of Service

Welcome to Cerveja! These Terms of Service ("Terms") govern your access to and use of the cerveja.app website and service (the "Service") operated by Cerveja ("we," "us," or "our").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Description of Service

Cerveja is a web application that allows users to send and track virtual "beer IOUs" to buddies. The Service enables you to:

  • Send virtual beers to others via invite links or directly to existing contacts
  • Track beers you owe and beers owed to you in a public ledger
  • Mark beers as "redeemed" when settled in real life

Cerveja does not involve real money, payments, or the exchange of actual goods. The Service is purely social and based on the honor system.

2. Symbolic Nature of Virtual Beers

2.1 Virtual Beers Are Symbolic Tokens

Virtual beers exchanged through Cerveja are symbolic tokens of social appreciation, similar to expressions like "I owe you one" or "let me buy you lunch." A virtual beer represents gratitude for a favor, the outcome of a buddy wager, or an invitation to connect - not a literal alcoholic beverage.

2.2 No Alcohol Sale or Delivery

Cerveja does not sell, deliver, advertise, or facilitate the purchase of alcoholic beverages. We have no partnerships with alcohol brands, bars, breweries, or retailers. No actual alcohol changes hands through our Service.

2.3 Real-World Redemption

If users choose to redeem a virtual beer by meeting in person, any real-world exchange is:

  • Entirely at the users' discretion and responsibility
  • Subject to all applicable laws regarding alcohol purchase and consumption
  • Not facilitated, tracked, or verified by Cerveja

Users are solely responsible for complying with legal drinking age requirements and all other laws in their jurisdiction.

2.4 Responsible Drinking

Cerveja encourages responsible drinking. If you or someone you know is struggling with alcohol, resources are available:

  • International: Visit your local health authority's website

2.5 Not a Drinking Game

Cerveja is not designed as a drinking game and should not be used to encourage, track, or gamify alcohol consumption. The Service is about celebrating friendship and social connections.

3. Eligibility

To use the Service, you must:

  • Be at least 18 years old
  • Have the legal capacity to enter into a binding agreement
  • Not be prohibited from using the Service under applicable law

By using the Service, you represent and warrant that you meet these requirements.

4. Account Registration

4.1 Account Creation

To use certain features, you must create an account by providing:

  • A valid email address and/or phone number
  • A unique username

You may also sign in using Google OAuth.

4.2 Account Security

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use

We are not liable for losses arising from unauthorized access to your account.

4.3 Account Deletion

You may delete your account at any time through your account settings. Upon deletion:

  • Your profile information will be removed
  • Your beer history will be anonymized or deleted
  • Some data may be retained as required by law

5. User Conduct

5.1 Prohibited Activities

You agree not to:

  • Use the Service for any illegal purpose
  • Harass, abuse, threaten, or harm other users
  • Impersonate any person or entity
  • Send spam, unsolicited messages, or phishing attempts
  • Attempt to gain unauthorized access to the Service or other accounts
  • Interfere with or disrupt the Service or its infrastructure
  • Circumvent any security measures or access controls
  • Scrape, crawl, or collect data from the Service without permission
  • Use automated systems (bots) to interact with the Service
  • Upload malware, viruses, or malicious code

5.2 Content Standards

When using the Service (including messages attached to beers), you agree not to post content that:

  • Is defamatory, obscene, or offensive
  • Infringes intellectual property rights
  • Contains personal information of others without consent
  • Promotes violence, discrimination, or illegal activities
  • Is fraudulent, deceptive, or misleading

We reserve the right to remove content and suspend accounts that violate these standards.

6. Public Ledgers

You acknowledge that Cerveja uses public ledgers.

This means:

  • Your username is publicly visible
  • Your avatar (if uploaded) is publicly visible
  • Your beer history (beers owed and owing, with messages) is publicly visible
  • Anyone can view your ledger at /u/[your-username]

Your email address and phone number are never publicly displayed.

If you do not want your beer activity to be public, do not use the Service.

7. Intellectual Property

7.1 Our Content

The Service, including its design, code, logos, and branding, is owned by Cerveja and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

7.2 Your Content

You retain ownership of content you submit (such as messages). By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content in connection with operating the Service.

7.3 Feedback

If you provide feedback or suggestions, we may use them without obligation to you.

8. Third-Party Services

The Service integrates with third-party services including:

  • Google OAuth for authentication
  • Vercel for hosting
  • Neon for database hosting

Your use of these services is subject to their respective terms and privacy policies. We are not responsible for third-party services.

9. Disclaimers

9.1 "As Is" Basis

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9.2 No Guarantee of Availability

We do not guarantee that the Service will be uninterrupted, secure, or error-free. We may modify, suspend, or discontinue the Service at any time without notice.

9.3 User Interactions

We are not responsible for disputes between users. Beer IOUs are informal social commitments, not legal obligations. We do not guarantee that any user will honor their virtual debts.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW: WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS (WHICH IS $0, SINCE THE SERVICE IS FREE).

Some jurisdictions do not allow these limitations, so they may not apply to you.

11. Indemnification

You agree to indemnify, defend, and hold harmless Cerveja and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Content you submit through the Service

12. Dispute Resolution

12.1 Informal Resolution

Before filing a formal dispute, you agree to contact us at legal@cerveja.app to attempt to resolve the issue informally. We will attempt to resolve disputes within 30 days.

12.2 Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles.

12.3 Jurisdiction

Any disputes not resolved informally will be subject to the exclusive jurisdiction of the courts located in San Francisco, California.

12.4 Class Action Waiver

You agree to resolve disputes with us on an individual basis. You waive the right to participate in class actions or class-wide arbitration.

13. Changes to These Terms

We may modify these Terms at any time. We will notify you of material changes by:

  • Posting the updated Terms on this page
  • Updating the "Last Updated" date
  • Sending an email notification (for significant changes)

Your continued use of the Service after changes constitutes acceptance. If you do not agree to the updated Terms, stop using the Service.

14. Termination

14.1 By You

You may stop using the Service and delete your account at any time.

14.2 By Us

We may suspend or terminate your account at any time, with or without cause, including for:

  • Violation of these Terms
  • Conduct that we believe is harmful to other users or the Service
  • Extended periods of inactivity
  • Legal or regulatory requirements

Upon termination, your right to use the Service ends immediately. Sections 7, 9, 10, 11, and 12 survive termination.

15. General Provisions

  • Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Cerveja regarding the Service.
  • Severability: If any provision of these Terms is found unenforceable, the remaining provisions remain in effect.
  • Waiver: Our failure to enforce any provision does not waive our right to enforce it later.
  • Assignment: You may not assign your rights under these Terms. We may assign our rights to any successor or affiliate.
  • No Agency: These Terms do not create any partnership, joint venture, or agency relationship between you and Cerveja.
